Drunk driving (OVI/DUI) penalties in Ohio

The mildest Ohio OVI jail sentence is three consecutive days.
However, judges have some alternatives, including:
- Sentencing an offender to both an intervention program and a jail term.
- Imposing an additional jail term (not to exceed six months).
- Suspending the execution of the jail term and placing the offender under a community control sanction.
Jail term penalties are much more severe for multiple offenses within a six year period.
Fines for Ohio OVI convictions are as follows:
- First offense: $375 to $1,075.
- Second offense (within six years): $525 to $1,625.
- Third offense (within six years): $850 to $2,750.
- Fourth or fifth offense (within six years): $1,350 to $10,500.
These fines are the mandatory amounts provided by Ohio law. However, a drunk driving charge can result in many other expenses, such as court costs and attorney fees and an increase in the cost of automobile insurance.
Ohio license suspension
There are two types of driver’s license suspensions in Ohio that are associated with OVI charges.
The first is an administrative license suspension (ALS). Your license will be suspended under Ohio’s implied consent law if you fail or refuse to take a chemical test after your OVI arrest.
The second way that a driver’s license is suspended is as a punishment after an OVI conviction. As with all other punishments, the punishment increases with multiple offenses, but if you are convicted of drunk driving in Ohio then your driver’s license will be suspended for at least six months.
